Rochester, MN (KROC AM News) - An Olmsted County jury has acquitted a former Rochester School District employee who was charged with having sex with a student.  

The not guilty verdict came Thursday in the trial of 40 year old Jody Nelson of Stewartville.

She was charged with one count of 3rd degree criminal sexual conduct last year. She had resigned her job as a district paraprofessional in 2013, about a month after the alleged incident was first reported.

The criminal complaint against Nelson indicates the incident occurred in 2009 at a Rochester home during a party. Police were told Nelson and the 16 year old Mayo High School student went into a bedroom for about an hour and had sex. He was among those who testified during the trial that began Tuesday and ended around 7 p.m. Thursday.
