Owatonna, MN (KROC AM News)  – The criminal case against a Blooming Prairie man accused of causing the death of his infant son has been dismissed.  

The Steele County Attorney’s office filed manslaughter and child endangerment charges last year against 31-year-old Cory Stucky.   

Authorities say Stucky drank heavily before falling asleep with his eight-week-old son, eventually suffocating the baby. According to the criminal complaint, Stucky told officers that he fell asleep with the baby on his chest and woke up to his girlfriend screaming and crying that the boy wasn't breathing. Initially, Stucky told police he had not been drinking and that he was a heavy sleeper. He later said he drank about 10 beers during the day on July 17th.

Defense attorney Bruce Rivers says the case was “a tragic accident” and charges should not have been filed. Rivers says there was no evidence of criminal negligence, which is necessary to meet the threshold of the charges that were filed against Stucky.
