Rochester, MN (KROC-AM News) - A Rochester man with a history of drunk driving arrests is being given a chance to avoid prison, but will have to serve six months in jail spread over the next six years.

47-year-old Brian Pickett recently pleaded guilty to a felony DUI charge stemming from his arrest in April, when his blood-alcohol-concentration was tested at nearly three times the legal limit. It was his fifth DUI offense since 1999, which resulted in the felony level charge.

The sentencing order issued by Olmsted County Judge Joseph Chase requires Pickett to spend 30 days in jail each year during his 7 years on probation until he completes his 180 day sentence. He was also given a stayed 42 month prison term that could be imposed on him if he fails to meet the terms of his probation.
