Winona, MN (KROC AM News) -  A Winona man was arraigned Thursday on a 2nd degree murder charge.

A felony assault charge and drive-by shooting count have also been filed against 49-year-old Ricky Waiters. He is scheduled to return to court next month for another hearing.

The criminal complaint says he fired at some people outside a bar around 1 a.m. July 27 and two men were hit. One was hit in the chest and died at the scene while the other man was struck in the leg.

Police later arrested Waiters at his home. A search turned up a .40 caliber handgun in his home and six spent shell casings in his car.  

The criminal complaint says witnesses told police Waiters had parked his car in front of the bar right before the shooting and apparently exchanged words with one of the men who had been outside. He opened fire and then drove off.

Police were told there were no previous altercations at the bar.
