Rochester, MN (KROC-AM News)- A convicted felon from Peterson has been summoned to appear in Olmsted County Court next month after he was found slumped over in his vehicle at a Rochester shopping center.

Charges filed Friday say Rochester Police responded to the report of a man slumped over in a running vehicle at the shopping center on the afternoon of February 10. After waking and interacting with the man, the officer believed he was impaired. 

Police then ordered 30-year-old Dalton Lee Volkman out of the vehicle to conduct field sobriety tests. The officer found two pocket knives on Volkman along with a marijuana pipe, according to the criminal complaint.

A subsequent search of the vehicle led to the discovery of a box containing 37 rounds of 9mm 3 ammunition, a bag in the passenger's seat that contained three clear plastic bags filled with suspected methamphetamine that weighed out to over 20 grams and numerous drug smoking pipes. Officers also found 30 smaller plastic bags, a scale, tubes, a straw, and a spoon in the bag that contained the suspected meth, items that indicate drug sale activity, the complaint says.

Volkman was taken to the Olmsted County Adult Detention Center where investigators obtained a warrant to draw a sample of his blood for testing. The results revealed the presence of amphetamine and methamphetamine in Volkman’s blood, the charges say.

Volkman is facing felony charges of first-degree drug sales, third-degree drug possession, DWI and ineligible ammunition possession. Court records indicate he was convicted of third-degree drug possession in Olmsted County last January. 

Volkman’s criminal history also includes three DWI convictions since 2015 in Olmsted, Winona and Fillmore Counties. He is due to make his first appearance in Olmsted County Court on July 27.
