Rochester, MN (KROC-AM News)- A detainee is facing felony charges after being accused of attacking a deputy at the Olmsted County Jail.

He’s alleged to have punched then kicked the deputy as he was awaiting sentencing  for convictions in prior criminal cases against him. 

The criminal complaint, filed on Thursday, says the attack occurred shortly before 3:30 on Monday afternoon. The detainee charged in the assault case is identified in the court filing as 27-year-old Dylan Cantrell Bathke

Bathke had asked the deputy for a piece of scratch paper then punched her in the face once she opened the door to his cell, the complaint says.

Bathke’s punch caused the deputy to fall backward, hit her face on a guardrail then fall to the ground. The Rochester man then kicked the deputy in the side of her head while she was down, the charges say.

A detective saw the deputy suffering from visible injuries on her head and face. She reported losing consciousness and vision during the alleged assault, according to the court document. 

Rochester Man Awaiting Sentencing for Smoke Shop Robbery, Domestic Assault Charged in Attack of Detention Deputy

Bathke was charged Thursday with one count of third-degree assault and a count of fourth-degree assault of a corrections officer. 

Court records indicate the alleged attack of the detention deputy occurred the day before Bathke was sentenced for convictions stemming from a robbery case and three domestic assault cases.

Bathke was accused of threatening to “stick” employees of Tony’s Smoke Shop at 440 Crossroads Dr. Southwest in May while stealing merchandise.

In the domestic assault cases, Bathke was charged with violating an order for protection. He received a 30 month prison sentence for the convictions in the previous cases. 

Olmsted County Adult Detention Center records indicate he’s still being held at the Olmsted County Jail. His next court appearance in the felony assault case has not yet been scheduled.
