Woman Who Bared Her Breasts at Rochester Kwik Trip Loses Appeal

St. Paul, MN (KROC-AM News) - The Minnesota Court of Appeals has upheld the conviction of a woman who was arrested in the parking lot of a Rochester convenience store after police responded to a complaint about a woman fully exposing her breasts at the business.

Court records indicate the incident that led to the arrest of Eloisa Plancarte occurred during an evening in July 2021 at a Rochester Kwik Krip store.

The appeals court ruling says the responding officers found her walking around the parking lot with her breasts fully exposed.

It also describes a conversation between the officers and Plancarte, who responded to an officer asking why she keeps exposing herself by saying "Catholic girls do it all the time." She then added, "I dance at the biker club; I'm a stripper."

She was taken into custody and while being processed into the Olmsted County jail, her purse was searched and a vial containing cocaine was found inside it.

Plancarte was charged with a misdemeanor count of indecent exposure and a felony drug possession count.

According to court documents, Plancarte argued that she was improperly arrested by police because female breasts should not be considered "private parts" under Minnesota's indecent exposure law.

She also asked the Appeals Court to consider whether her prosecution violated the Equal Protection Clause of the US Constitution because men are not charged when they walk around bare-chested.

The Court of Appeals, in a split decision, rejected both arguments. Plancarte was sentenced to 90 days in jail for her conviction on the indecent exposure charge, while she was placed on probation and granted a stay of adjudication for the drug charge.
