Rochester, MN (KROC AM News) – Attorneys for two suspected Rochester drug dealers are trying to have their cases thrown out due to improper police conduct and are basing their arguments on hidden cameras.

Arguments were made Friday before Olmsted County Judge Pamela King in the cases of 33-year-old Kyle Peterson and 29-year-old Jennifer Nou.

Peterson’s attorney presented most of the challenge that is based on a 2018 search of a home where the two suspects lived.

James McGeeney told the judge the officers who conducted the search committed “egregious behavior” by looking at notes Peterson had written about his upcoming trial. McGeeney said their behavior was outside the scope of the warrant and violated the due process of both defendants. McGeeney says the officers’ actions were recorded by hidden cameras in the home and copies were given to the judge during Friday’s hearing.

The judge is expected to issue a ruling on the defense request soon.

Peterson and Nou were busted twice during 2017 after searches of their homes turned up heroin, cocaine, marijuana and other drugs and numerous evidence linked to drug dealing.
