Rochester, MN (KROC-AM News) - Olmsted County prosecutors have given notice they intend to seek an aggravated sentence in the case of the Dover man who was arrested earlier this week on charges he assaulted two men in a bar Wednesday night.

The court motion argues 31-year-old Joseph Martin is a danger to public safety based on his violent criminal history and the vulnerability of the two victims of the recent assault at the Road Trip Bar. Prosecutors say, after Martin left both men dazed and defenseless by knocking them unconscious with multiple punches on the head, he allegedly struck one of the men after he began to regain consciousness, and kept assaulting the second man even after he had been knocked out.

Martin's criminal history includes a 2014 conviction for second-degree criminal sexual conduct that resulted in a 7 1/2 year prison sentence. In that case, he was accused of holding a woman against her will and both physically and sexually assaulting her. Court documents also indicate he was convicted of third-degree assault in 2019.

Martin was arraigned Friday on a criminal complaint stemming from the incident Wednesday in Dover. It charges him with two counts of third-degree assault and obstructing the legal process. His bail was set at $200,000.
