Rochester, MN (KROC AM News) - A Rochester man who squirted a mixture of urine and feces into the face of an Olmsted County detention deputy has been sentenced to prison. But he won’t actually do any time for the crime.

Sentenced on a felony assault charge Thursday was 25-year-old Byron Rush.

The incident happened in May while he was in jail waiting to be transferred to prison for two armed robbery convictions. The Olmsted County Sheriff’s office says Rush squirted the deputy when she opened his cell door. The deputy accidentally swallowed some of the mixture that was in a shampoo bottle.

As part of his sentence, Rush has been ordered to pay restitution of $3400. He has also been ordered to be tested for infectious diseases and send the results to the victim.

He was given a 17-month prison term but it will run concurrent or at the same time as the six-year sentence he was given for the robbery convictions.

He admitted robbing a hotel and a tanning salon last December.
